MANIFIESTAN:
Las partes acuerdan celebrar el presente Contrato de Split Commission y Colaboración para Referidos Sin Licencia, conforme a las siguientes:
CLÁUSULAS
PRIMERA. OBJETO DEL CONTRATO
El presente contrato regula la colaboración entre el Agente Licenciado y Pro Financial Group respecto de los referidos aportados por personas aún no licenciadas como agentes de seguros (en adelante, el "Referidor Sin Licencia").
El Agente Licenciado se compromete a:
Realizar la presentación del negocio de Pro Financial Group al referido.
Gestionar la venta de la póliza correspondiente.
Ejecutar un split de comisión equivalente al 20% del valor de la prima mensual de cada póliza vendida en profundidad derivada de estos referidos, a favor de Pro Financial Group, con el propósito de garantizar el pago futuro al Referidor Sin Licencia una vez obtenga su licencia.
SEGUNDA. GARANTÍA DE PAGO AL REFERIDOR SIN LICENCIA
Pro Financial Group recibirá y reservará el split del 20% hasta que el Referidor Sin Licencia obtenga su licencia de seguros de vida.
Una vez obtenida, Pro Financial Group procesará el pago correspondiente al Referidor Sin Licencia como reconocimiento a su labor de referenciación. Estos pagos serán reconocidos únicamente por los clientes sometidos dentro de los cuarenta y cinco (45) días previos a la obtención de la licencia del Referidor Sin Licencia, conforme a lo estipulado en el contrato de colaboración del referidor.
TERCERA. OBLIGACIONES DEL AGENTE LICENCIADO
Split de Comisión:
El Agente Licenciado ejecutará el split del 20% sobre la prima mensual al momento de someter la póliza.
Identificación de Referidos:
El Agente Licenciado identificará claramente que la venta corresponde a un referido sin licencia, proporcionando nombre completo y datos de contacto del Referidor Sin Licencia.
Comunicación Documental:
Toda notificación se enviará a Info@profinancialgroup.com, incluyendo información de la póliza, split realizado e identificación del Referidor Sin Licencia.
CUARTA. RESPONSABILIDAD Y LIMITACIONES
El Agente Licenciado reconoce que la omisión en la ejecución del split de comisión exime a Pro Financial Group de responsabilidad sobre el pago al Referidor Sin Licencia.
QUINTA. VIGENCIA
El presente contrato entra en vigor a partir de su firma y permanecerá vigente mientras el Agente Licenciado mantenga relación comercial con Pro Financial Group, salvo terminación mediante notificación escrita con treinta (30) días de antelación.
SEXTA. LEGISLACIÓN APLICABLE
Este contrato se regirá por las leyes del Estado de Carolina del Norte, Estados Unidos de América.
Esta versión en español es una traducción verdadera y exacta del contrato original redactado en inglés. Ambas partes reconocen y aceptan su contenido, y firman a continuación como señal de su plena conformidad. En caso de discrepancia o problemas de interpretación, prevalecerá la versión en inglés.

SPLIT COMMISSION AND COLLABORATION AGREEMENT FOR UNLICENSED REFERRALS.

(Hereinafter, "Pro Financial Group"); And: , Address:

RECITALS:
The parties agree to enter into this Split Commission and Collaboration Agreement for Unlicensed Referrals, under the following terms:
CLAUSES
FIRST. PURPOSE OF THE AGREEMENT
This agreement governs the collaboration between the Licensed Agent and Pro Financial Group regarding referrals provided by individuals not yet licensed as insurance agents (hereinafter, the "Unlicensed Referrer").
The Licensed Agent commits to:
- Present the Pro Financial Group business opportunity to the referred client.
- Manage the sale of the corresponding policy.
- Execute a commission split equivalent to 20% of the monthly premium value of each policy sold in depth resulting from these referrals, in favor of Pro Financial Group, to guarantee future payment to the Unlicensed Referrer once they obtain their license.
SECOND. GUARANTEE OF PAYMENT TO THE UNLICENSED REFERRER
Pro Financial Group will receive and reserve the 20% split until the Unlicensed Referrer obtains their life insurance license.
Once obtained, Pro Financial Group will process the corresponding payment to the Unlicensed Referrer in recognition of their referral efforts. These payments will only be recognized for clients submitted within the forty-five (45) days prior to the Unlicensed Referrer obtaining their license, as stipulated in the referrer's collaboration agreement.
THIRD. OBLIGATIONS OF THE LICENSED AGENT
- Commission Split:
- The Licensed Agent shall execute the 20% split on the monthly premium at the time of submitting the policy.
- Identification of Referrals:
- The Licensed Agent shall clearly identify that the sale corresponds to an unlicensed referral, providing the full name and contact information of the Unlicensed Referrer.
- Documentary Communication:
- All notifications shall be sent to Info@profinancialgroup.com, including policy details, split confirmation, and Unlicensed Referrer identification.
FOURTH. RESPONSIBILITY AND LIMITATIONS
The Licensed Agent acknowledges that failure to execute the commission split releases Pro Financial Group from any responsibility regarding payment to the Unlicensed Referrer.
FIFTH. TERM
This agreement shall become effective upon signature and will remain in force as long as the Licensed Agent maintains a commercial relationship with Pro Financial Group, unless terminated by written notice with thirty (30) days' prior notice.
SIXTH. GOVERNING LAW
This agreement shall be governed by the laws of the State of North Carolina, United States of America.
The English version is a true and accurate translation of the original contract drafted
in Spanish. Both parties acknowledge and accept its content, and sign below as a
sign of their full agreement. In the event of any discrepancy or issues of
interpretation, the English version shall prevail.
